1. Agreement
These terms govern your use of fieldconfirm.com and the Field Confirm software at app.fieldconfirm.com (the “Services”), provided by F3 Intelligence Corp. (“F3 Intelligence,” “we,” “us”). By using the Services you agree to these terms. If you use the Services for an organization, you agree on its behalf and confirm you are authorized to do so. If your organization has signed a separate agreement or order form with F3 Intelligence, that agreement controls where it conflicts with these terms.
2. What Field Confirm does — and does not do
Field Confirm is software for coordinating assignments and keeping records. Field Confirm coordinates assignments and records; it does not perform service, certify legal sufficiency, or guarantee outcomes. In particular:
- Field Confirm is not a licensed private investigation agency, process service company, or law firm, and does not provide legal advice.
- Agencies and their providers perform the work and remain solely responsible for it, including holding any required licenses, registrations, and insurance, and for whether service of process or any report meets the requirements of a court or jurisdiction.
- Eligibility checks, rankings, and records in the Services support an agency’s decisions; they do not replace the agency’s own judgment and legal obligations.
3. Accounts and eligibility
You must be at least 18 and able to form a binding contract. Keep your sign-in methods secure, do not share accounts, and tell us promptly about any unauthorized use. You are responsible for activity under your account. Agencies are responsible for the users they invite and the roles they grant.
4. Acceptable use
You may use the Services only for lawful, authorized professional work. You must not:
- use the Services to stalk, harass, threaten, or locate a person for any unlawful purpose, or to obtain information under false pretenses where prohibited by law;
- enter or use personal information without a lawful basis and any authority, consent, or permissible purpose the law requires;
- upload unlawful content, malware, or material you have no right to share;
- access information or roles you are not authorized for, or probe, scan, or test the Services’ security without our written permission;
- interfere with or overload the Services, or copy, resell, or reverse engineer them except as the law allows; or
- misrepresent your identity, licenses, or authority.
5. Your data
As between you and Field Confirm, your organization owns the content it puts into the Services (“Customer Data”). You give us permission to host, process, and display Customer Data as needed to provide and secure the Services and as your organization instructs. You are responsible for having the rights, notices, and consents needed for the Customer Data you provide. Our privacy policy explains how we handle personal information.
6. Fees
Paid features are billed as set out in your order form or the pricing shown in the Services. Unless stated otherwise, fees are non-refundable and exclusive of taxes. Payments are handled by third-party payment processors under their own terms.
7. Preview features
Field Confirm is currently offered in private preview. Preview features may change, be limited, or be withdrawn, and may not be suitable for every workflow. We will try to give reasonable notice of material changes.
8. Our property and feedback
F3 Intelligence owns the Services and all related software, designs, and trademarks. These terms give you a limited, non-exclusive, non-transferable right to use the Services while you comply with them. If you send us feedback, we may use it without obligation to you.
9. Third-party services
The Services may connect to third-party services, such as email, messaging, payment, or verification providers. Those services are governed by their own terms, and we are not responsible for them.
10. Suspension and termination
You may stop using the Services at any time. We may suspend or end access if you breach these terms, if required by law, or to protect the Services or others. Where practical we will give notice and a chance to export Customer Data, subject to your agreement and applicable law. Sections that by their nature should survive termination will survive.
11. Disclaimers
To the fullest extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted or error-free, or that any assignment will produce a particular result.
12. Limitation of liability
To the fullest extent permitted by law, F3 Intelligence will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability arising out of or relating to the Services will not exceed the greater of the amounts you paid us for the Services in the twelve months before the claim, or one hundred U.S. dollars. Some jurisdictions do not allow these limitations, so they may not fully apply to you.
13. Indemnity
You will defend and indemnify F3 Intelligence against third-party claims arising from your Customer Data, the work your organization or its providers perform, or your violation of these terms or the law.
14. Governing law and disputes
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Florida, and both parties consent to their jurisdiction, unless your agreement with F3 Intelligence says otherwise.
15. General
We may update these terms by posting a new version here with a new “last updated” date; for material changes we will give notice through the Services, and continued use after the change takes effect means you accept it. If any provision is unenforceable, the rest remains in effect. Failure to enforce a provision is not a waiver. You may not assign these terms without our consent.
